HVACFolioHVACFolio helps qualified professionals document field work. It does not replace training, codes, manufacturer instructions, required instruments or professional judgment.
1. Agreement
These Terms govern your use of the HVACFolio iOS app and related website. By using the App, you agree to these Terms and Apple’s applicable App Store terms. If you use the App for an organization, you confirm that you are authorized to accept these Terms for it.
2. Permitted use
We grant you a limited, non-exclusive, non-transferable, revocable right to use the App for lawful service-report and field-work purposes. You must comply with applicable laws, safety rules, trade licensing requirements, manufacturer instructions and customer agreements.
3. Professional responsibility
Calculators, templates, suggested fields and generated reports are documentation aids only. Results depend on the accuracy of inputs. You must independently verify readings, calculations, diagnoses, safety conditions and code requirements before relying on or delivering a report. The App does not certify that equipment is safe, compliant, efficient or fit for use.
4. Customer data and consent
You are responsible for having authority to enter, photograph, store and share customer, property, equipment and signature information. You must provide any notice and obtain any consent required by law or your customer agreement. Review exported reports before delivery.
5. Subscriptions and billing
The App permits up to two service reports without a paid subscription. HVACFolio Pro provides access to unlimited reports and other Pro features while the subscription is active.
- Available plans are displayed in the App, including the price charged in your App Store storefront.
- Payment is charged to your Apple Account when you confirm purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your Apple Account is charged for renewal within 24 hours before the current period ends.
- You can manage or cancel subscriptions in your Apple Account subscription settings.
- Refund requests are handled by Apple under its refund policies.
Deleting the App does not cancel a subscription. If a displayed website price differs from the purchase sheet, the App Store purchase sheet controls.
6. Your content and local storage
You retain rights in content you enter. We do not claim ownership of your reports. The App stores report content locally; you are responsible for your device, backups and exported copies. We are not responsible for content lost because of device failure, deletion, operating-system changes or lack of a backup.
7. Acceptable use
You may not misuse the App, attempt to defeat subscription controls, reverse engineer it except where law expressly permits, use it to violate privacy or intellectual-property rights, or represent the App’s output as a government or manufacturer certification.
8. Intellectual property
The App, brand, interface, software, templates and website are owned by us or our licensors and are protected by applicable law. These Terms do not transfer ownership to you.
9. Availability and changes
We may improve, change or discontinue features, subject to applicable law. We do not guarantee that every feature will be available on every device, language, region or operating-system version.
10. Disclaimers
To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, equipment damage, property damage or business interruption arising from the App. Our aggregate liability relating to the App will not exceed the amount you paid for HVACFolio during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
12. Termination
You may stop using the App at any time. We may suspend access for material misuse or where required by law. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws applicable in the Province of Ontario and the federal laws of Canada, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction continue to apply.
